OVERVIEW

Welcome to Lightning Elite Designs. The terms “we,” “us,” and “our” refer to Lightning Elite Designs.

Lightning Elite Designs operates this website and online store, including all related information, content, features, tools, products, and services (collectively, the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using the Services.

Please read these Terms carefully. By visiting, accessing, or using the Services, creating an account, or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

Nothing in these Terms limits any rights or remedies that cannot legally be excluded under applicable consumer-protection legislation.

SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNTS

Lightning Elite Designs is a business-to-business costume supplier. Purchasing access is limited to approved dance studio owners or directors, school dance program directors, figure skating club directors, performing arts or theatre program directors, and qualifying brick-and-mortar dancewear retailers.

Submitting an application does not guarantee approval. We reserve the right to approve, refuse, suspend, or revoke account access when reasonably necessary to protect our business, customers, pricing, designs, or Services.

You must provide accurate, current, and complete information when applying for or using an account. You must promptly update your information if it changes.

You are responsible for maintaining the confidentiality and security of your login credentials and for all activity conducted through your account. Approved access is issued to the approved organization and its authorized representatives. You must not share, transfer, sell, assign, or sublicense your account or permit unauthorized individuals or businesses to use it.

You must notify us promptly at designs@lightningelite.ca if you believe your account has been accessed or used without authorization.

By agreeing to these Terms, you represent that you are at least the age of majority in your province or territory of residence and that you have authority to enter into this agreement on behalf of the organization associated with your account.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

We make reasonable efforts to display and describe our products accurately. However, colours and product appearance may vary depending on your screen, device settings, lighting, fabric dye lots, material availability, and manufacturing processes.

Images, drawings, mock-ups, and digital renderings are provided as visual references. The finished product may have minor variations from the product image or rendering. Minor variations that do not materially affect the overall design, function, or quality of the product are not considered defects.

All product descriptions, designs, materials, embellishments, availability, and prices are subject to change without notice. If a material, trim, fabric, stone, or other component becomes unavailable after an order is placed, we may contact you to discuss a reasonably comparable substitution.

We reserve the right to discontinue products, limit quantities, or restrict sales to particular customers, organizations, geographic regions, or jurisdictions.

SECTION 3 — MADE-TO-ORDER PRODUCTS

Lightning Elite Designs costumes are custom made to order and are not kept as finished inventory.

Our approximate delivery timeline is fourteen weeks unless otherwise stated in the product description, order confirmation, or written communication from us. This timeline includes production and estimated delivery but is an estimate only and is not guaranteed.

Production may be affected by order volume, material availability, factory closures, statutory holidays, carrier delays, customs processing, severe weather, labour disruptions, or other circumstances outside our reasonable control.

Customers are responsible for ordering sufficiently in advance of rehearsals, photos, performances, competitions, recitals, or other events. Lightning Elite Designs is not responsible for losses, missed events, replacement costs, or other expenses resulting from an order arriving later than anticipated unless required by applicable law.

SECTION 4 — SIZING AND MEASUREMENTS

Customers are responsible for reviewing the applicable size chart and selecting the correct size for each performer.

Measurements should be taken accurately and compared with the size chart before an order is submitted. Recommendations or general sizing assistance provided by Lightning Elite Designs do not replace the customer’s responsibility to verify measurements and choose the final size.

We are not responsible for fit issues resulting from incorrect measurements, incorrect size selection, growth, weight changes, individual body proportions, personal fit preferences, or measurements taken too far in advance.

Made-to-order costumes cannot be returned or exchanged because an incorrect size was selected unless the costume differs materially from the size ordered or is defective.

SECTION 5 — CUSTOMIZATION

Basic customization may be available for certain designs. Customers must contact designs@lightningelite.ca before ordering to confirm availability, pricing, and instructions.

Basic customization may include:

  • One colour change, starting at $15 per piece;

  • Two colour changes, starting at $20 per piece; or

  • Adding mesh to the centre of an eligible two-piece design, starting at $20 per piece.

Prices are starting prices and may change depending on the design, fabrics, materials, quantities, and requested modification.

Customization is not confirmed until Lightning Elite Designs provides written approval. Requests included only in an order note are not guaranteed to be completed.

The customer is responsible for reviewing all written customization details and approving any applicable mock-up, colour selection, or order summary. Customized products are final sale except where defective, damaged, or otherwise required by law.

SECTION 6 — ORDERS

Placing an order constitutes an offer to purchase. An order is not accepted until payment has been successfully processed and we have confirmed the order.

Please review all products, quantities, sizes, colours, customizations, billing information, shipping information, and event deadlines before submitting your order.

We reserve the right to accept, decline, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing or product errors, material unavailability, production limitations, account misuse, or an inability to fulfil the order as requested.

If we decline or cancel an order after payment has been received, we will issue any refund legally owing to the original payment method.

If we need clarification regarding an order, production may be paused until the customer responds. Any delay in receiving required information or approval may extend the estimated delivery timeline.

SECTION 7 — CANCELLATIONS, RETURNS AND REFUNDS

Because our products are made to order, orders become final once production has begun.

Cancellation requests must be submitted in writing to designs@lightningelite.ca within 24 hours of placing the order. We will make reasonable efforts to accommodate requests received during this period, but cancellation is not guaranteed if materials have been ordered or production has already started.

Made-to-order, customized, and personalized products are final sale and are not eligible for return, exchange, or refund because of incorrect sizing, change of mind, duplicate ordering, event cancellation, or personal preference.

Damaged, defective, or materially incorrect products must be reported to designs@lightningelite.ca within seven days of delivery. The customer must include the order number, a description of the issue, and clear photographs showing the product and the reported concern.

Please do not wear, alter, wash, repair, decorate, stone, or otherwise modify an item before contacting us about a possible defect. Items that have been worn, washed, altered, or modified may not qualify for a remedy unless otherwise required by law.

If we confirm that an item is defective, damaged, or materially different from the approved order, we will determine an appropriate remedy, which may include repair, replacement, store credit, or refund.

Nothing in this section limits any right or remedy available under applicable law.

SECTION 8 — PRICES, TAXES AND BILLING

All prices are listed in Canadian dollars unless otherwise stated.

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price shown when the order is submitted, subject to correction of obvious errors.

Unless expressly stated otherwise, displayed product prices do not include applicable sales taxes, shipping charges, customs charges, duties, brokerage fees, or other charges. Applicable taxes and shipping charges will be calculated and displayed during checkout.

You agree to provide current, complete, and accurate account, billing, payment, and shipping information. You authorize us and our payment processors to charge the payment method provided for the complete order total.

If a pricing or product-information error is discovered after an order is submitted, we may contact you to correct the order or cancel and refund it.

SECTION 9 — SHIPPING AND DELIVERY

We currently ship to eligible Canadian addresses within the shipping regions shown at checkout.

Available shipping rates, free-shipping thresholds, and delivery information are displayed during checkout and may be updated from time to time.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping costs resulting from an incorrect or incomplete address, refused delivery, unsuccessful delivery attempt, or unclaimed package may be charged to the customer.

Tracking information will be provided when available. Customers are responsible for monitoring tracking information and promptly contacting the carrier or Lightning Elite Designs if a delivery issue occurs.

Delivery dates and transit times are estimates only. We are not responsible for carrier delays, customs delays, severe weather, labour disruptions, incorrect addresses, or other circumstances outside our reasonable control.

If a package is lost or arrives damaged, please contact designs@lightningelite.ca promptly so that we can assist with the carrier’s investigation or claim process.

SECTION 10 — INTELLECTUAL PROPERTY

The Services and their contents—including costume designs, product names, drawings, photographs, graphics, logos, text, videos, catalogues, layouts, and other materials—are owned by or licensed to Lightning Elite Designs and are protected by Canadian and applicable international intellectual-property laws.

Approved account access does not grant permission to reproduce, copy, manufacture, modify, distribute, publish, sell, license, reverse engineer, or create derivative products based on our designs or content.

You may use product images solely to promote legitimate Lightning Elite Designs products purchased or offered through your approved organization, provided the images are not materially altered and are not used in a misleading manner.

You may not provide our protected pricing, catalogue materials, account access, or other restricted content to unauthorized businesses, manufacturers, competitors, or members of the general public.

Lightning Elite Designs, its logos, product names, designs, and slogans may not be used without our prior written permission. All rights not expressly granted are reserved.

SECTION 11 — OPTIONAL AND THIRD-PARTY TOOLS

The Services may provide access to tools, applications, or features operated by third parties. We do not control these third-party services and provide access to them on an “as is” and “as available” basis.

Your use of third-party tools is at your own discretion and may be governed by the third party’s separate terms and privacy policies.

We may introduce new features, tools, or resources in the future. Any such features will form part of the Services and will be subject to these Terms.

SECTION 12 — THIRD-PARTY LINKS

The Services may contain links to websites, services, or resources operated by third parties.

We are not responsible for examining or evaluating the accuracy, content, security, products, services, or practices of third-party websites. Accessing third-party websites is at your own discretion and risk.

Questions or complaints concerning third-party products or services should be directed to the applicable third party.

SECTION 13 — RELATIONSHIP WITH SHOPIFY

Lightning Elite Designs is powered by Shopify, which enables us to provide the Services. However, purchases made through our store are transactions directly between you and Lightning Elite Designs.

Shopify is not the seller of our products and is not responsible for our products, order fulfilment, customer service, refunds, or any injury, loss, or damage arising from products purchased from Lightning Elite Designs.

To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from your purchases and transactions with Lightning Elite Designs.

SECTION 14 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our store is hosted by Shopify, Shopify collects and processes certain information relating to your access to and use of the Services. Some personal information may be processed by Shopify or other service providers in jurisdictions outside your province or country.

Shopify’s applicable privacy information can be reviewed through Shopify’s privacy policy.

SECTION 15 — FEEDBACK, REVIEWS AND SUBMISSIONS

If you submit reviews, photographs, ideas, suggestions, proposals, or other feedback to us, you confirm that you have the necessary rights and permission to provide that content.

Unless otherwise agreed in writing, you grant Lightning Elite Designs a non-exclusive, worldwide, royalty-free licence to use, reproduce, edit, publish, distribute, and display voluntarily submitted feedback or reviews for business, promotional, and operational purposes.

We are not obligated to keep unsolicited feedback confidential, provide compensation for it, or respond to it.

You must not submit content that is unlawful, misleading, defamatory, obscene, abusive, infringing, or harmful, or that contains malware or violates another person’s privacy or intellectual-property rights.

SECTION 16 — ERRORS, INACCURACIES AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, production timelines, or other information.

We reserve the right to correct errors, update information, or cancel an affected order. If an order is cancelled because of our error, we will refund any amount legally owing.

SECTION 17 — PROHIBITED USES

You may use the Services only for lawful purposes.

You must not use the Services:

  • To violate any federal, provincial, territorial, municipal, or international law;

  • To infringe our rights or the rights of another person;

  • To copy, reproduce, manufacture, distribute, or commercially exploit our designs or restricted content without permission;

  • To harass, threaten, abuse, defame, discriminate against, or harm another person;

  • To submit false, fraudulent, or misleading information;

  • To transmit malware, viruses, or harmful code;

  • To collect or track another person’s personal information without authorization;

  • To spam, phish, scrape, crawl, or improperly extract data;

  • To bypass our account approval, security, pricing, or authorization controls;

  • To share protected wholesale pricing or catalogue access with unauthorized persons;

  • To interfere with the operation or security of the Services; or

  • To impersonate another person, organization, or approved customer.

We may suspend or terminate account access if we reasonably believe these Terms have been violated.

SECTION 18 — AUTOMATED ACCESS

Automated systems, agents, bots, scrapers, or similar technologies must not access or interact with the Services in a manner that conceals their automated nature, bypasses security controls, circumvents access restrictions, or collects protected content without authorization.

We may use technical measures to limit or prevent automated access to the Services.

SECTION 19 — TERMINATION

We may suspend or terminate your account or access to any part of the Services if you breach these Terms, misuse restricted content, engage in suspected fraud, or create a security or legal risk.

Termination does not affect payment obligations or other liabilities arising before termination.

Sections relating to intellectual property, payment obligations, privacy, liability, indemnification, governing law, and any provisions that by their nature should continue will survive termination.

SECTION 20 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available, or that all information will always be complete or current.

Except for warranties or conditions that cannot legally be excluded, we disclaim all express or implied representations, warranties, and conditions relating to the Services and products, including implied warranties or conditions of merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Nothing in this section excludes any warranty, condition, right, or remedy that cannot legally be excluded.

SECTION 21 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Lightning Elite Designs and its owners, employees, contractors, agents, service providers, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, including lost profits, lost revenue, lost opportunities, replacement costs, or loss of data arising from the use of the Services or products.

We are not responsible for losses arising from an event deadline, performance, recital, competition, photoshoot, or other occasion when the customer did not allow sufficient time for production, delivery, fitting, or alterations.

This limitation does not apply to liability that cannot lawfully be excluded or limited.

SECTION 22 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless Lightning Elite Designs, Shopify, and their respective owners, affiliates, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, or reasonable legal costs arising from:

  • Your material breach of these Terms;

  • Your unlawful use of the Services;

  • Your infringement of another person’s rights; or

  • Your unauthorized reproduction, disclosure, distribution, or commercial use of our protected content or designs.

This obligation does not apply to the extent a claim results from the negligence or unlawful conduct of the party seeking indemnification.

SECTION 23 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed from these Terms.

The remaining provisions will continue in full force and effect.

SECTION 24 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce a right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies and rules posted through the Services, constitute the entire agreement between you and Lightning Elite Designs concerning your use of the Services and supersede previous communications or agreements concerning the same subject matter.

SECTION 25 — ASSIGNMENT

You may not transfer or assign your account, these Terms, or your rights or obligations under them without our prior written consent.

We may assign our rights and obligations as part of a business reorganization, sale, transfer, or other lawful transaction.

SECTION 26 — GOVERNING LAW

These Terms and any separate agreement through which we provide the Services are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Subject to any rights you may have under applicable consumer-protection legislation, disputes will be submitted to the courts of Alberta, Canada.

SECTION 27 — CHANGES TO THESE TERMS

The current version of these Terms will be available on this page.

We may update these Terms from time to time by posting a revised version. When required by law, we will provide notice of material changes.

The revised Terms will take effect on the date stated in the updated version. Continued use of the Services after that date constitutes acceptance of the revised Terms.
